Please read these Terms carefully before using our store. These Terms and Conditions, together with our Privacy Policy, govern your use of GiftMira and the purchase of any products through our website at www.giftmira.com, operated by GiftMira ("we", "us", or "our"). By placing an order, you agree to be bound by these Terms.

1. Our Products

Product images on our website are for illustrative purposes only. Colors and details may vary slightly from what is displayed on your screen. All products are subject to availability — if an item becomes unavailable, we will notify you by email and will not process that order.

2. Eligibility

You must be at least 18 years old to purchase from our website. Nothing in these Terms affects your statutory rights, including your right to receive products that match their description, are of satisfactory quality, and are fit for purpose.

3. How a Contract Is Formed

A binding contract is formed only when we issue written acknowledgement and acceptance of your order. We may, at our sole discretion, decline any order. In any conflict between the online price and our order acknowledgement, the latter takes precedence.

4. Product Descriptions & Pricing

We work hard to keep product information accurate and current. However, we do not guarantee the absence of errors in descriptions, pricing, or availability. We reserve the right to update product information at any time — but such changes will not affect orders for which you have already received a confirmation email.

5. When Orders Are Not Accepted

We may decline an order if you provide incomplete or fraudulent information, there is a website error regarding price or description, the item is out of stock, or we have reasonable grounds to believe you intend to resell the products. If we cannot accept your order, we'll contact you within 30 days and issue a full refund.

6. Order Cancellation

By us: GiftMira reserves the right to cancel any accepted order before delivery — for example, due to an event outside our control, a website error, or at your request. You will be notified by email and refunded within 15 business days.

By you: You may cancel your order within 24 hours of placement by emailing hello@giftmira.com with your order number, provided it has not yet shipped. After 24 hours, your order may already be in processing or shipped and cannot be canceled — you are welcome to return eligible items under our Return & Refund Policy. A 15% restocking fee applies to change-of-mind returns; full details are in our Refund Policy.

7. Availability of Products

GiftMira reserves the right to withdraw or suspend any product from sale at any time without notice. We are not liable for losses arising from product unavailability.

8. Passing of Risk & Title

Risk in the product passes to you upon delivery. Legal title remains with GiftMira until full payment has been received.

9. Chargebacks

You agree to contact us before raising a chargeback or dispute with your bank or card issuer. If you initiate a chargeback without merit or legitimate reason, we reserve the right to provide compelling evidence to refute the claim and/or pursue appropriate legal remedies.

10. Delivery

We ship within the United States only. Orders are processed within 1–3 business days and typically arrive within 5–15 business days after shipping. We aim to fulfill your order by the estimated delivery date shown in your shipping confirmation email. Full details are in our Shipping Policy.

11. Our Right to Update These Terms

We reserve the right to revise these Terms at any time. Every time you place an order, the Terms in force at that time apply. Any revisions will be noted by updating the date at the top of this page.

12. Our Liability

We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our negligence. Products are for personal, non-commercial use only. We are not liable for loss of profit, business interruption, or any commercial losses. Nothing in these Terms limits our liability for death or personal injury caused by our negligence.

13. Events Outside Our Control

We are not liable for failure to perform our obligations due to events beyond our reasonable control — including natural disasters, strikes, war, terrorism, fire, flood, or failure of telecommunications networks. We will notify you promptly and arrange an alternative delivery date where applicable.

14. Privacy & SMS Marketing

GiftMira processes your personal data in accordance with our Privacy Policy.

By consenting to GiftMira's SMS marketing at checkout or via our subscription tools, you agree to receive recurring text notifications (order updates, abandoned checkout reminders, marketing offers, and review requests), even if your number is on a do-not-call list. 15. Billing & Account Information

We reserve the right to refuse, limit, or cancel orders at our sole discretion. You agree to provide accurate, current purchase and billing information and to update it promptly as needed.

16. Other Important Terms

These Terms are governed by the laws of the State of Wyoming, United States. If any provision is found to be unlawful or unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and GiftMira.
